On Monday, the District of Columbia Court of Appeals rejected a full-fledged hearing of West Flagler’s lawsuit against the U.S. Department of the Interior. This means that South Florida game operators wanted all judges in certain courts to hear their cases to prevent Hard Rock Bet from re-launching in Florida.
The Home Office responded to West Flagler’s request for a retrial on August 14, which did not necessarily mean that anything was imminent, as it took months for the court to comply with a retrial permit in the past. However, it did not take long this time, with the court stating, “We order to reject the petition in consideration of the plaintiffs’ petition for a full-scale review, their response, and the absence of a request for a vote by court members.”
Under the court’s decision, which will not take effect until eight days after the ruling, Hard Rock Bet can start betting online and in retail stores as early as Tuesday, September 19, according to the appellate court ruling. 경마
West Flagger may file a lawsuit in the Supreme Court of the United States to prevent the re-launch of the Seminole Tribe. The South Florida game operator may also seek to prevent a relaunch by filing a lawsuit in Florida state courts based on the 2018 Amendment 3, which requires the expansion of gambling to be placed before voters. But legal experts think neither of these cases will benefit West Flagger, and in the meantime, hard rock bets will not be open to business.
At the heart of the matter is whether the U.S. Department of the Interior has duly approved a 2021 agreement signed by Governor Ron DeSantis between Florida and the Seminole tribes, which gave tribes exclusive rights to retail and sports betting in Sunshine State.
This is, of course, the second time the Seminole tribe has opened its sports betting business in 2021 for the first time, in more than a month, before closing under court orders due to legal challenges from West Flagler, which runs the Bonita Springs poker room in South Florida.
